[rsbac] kernel and premature OOM kills

Has anyone experienced premature OOM kills [i.e. instead of swapping the
kernel kills processes, OOM=Out Of Memory] in kernels 2.6.8 and 2.6.9 ? 
I thought it was a problem of RedHat patches and I reported it a couple
of months ago to them, but it is turning out to be a common problem
present also on vanilla kernels. It seems that 2.6.7 is not affected.
